Security and Privacy Rule Print E-mail
It is important to understand the difference between Security Rule and the Privacy Rule as it applies to HIPPA and Artex Medical, Inc.

Security Rule pertains to all protected health information (PHI) that is transmitted via electronic methods.

Electronic methods refer to computer database, claims transmission, email, and backup tapes storage, delivery tracking systems, fax machines and phone lines. Artex Medical, Inc. secures its database with firewalls and user-control systems (i.e. user passwords). In addition, when no activity occurs after 30 seconds a screen-saver covers the computer screen. After 15 min of in-activity, the computer will automatically log the user off and requires the user’s password to be unlocked. Faxed information must contain a fax cover sheet to protect the health information of a person. All fax coversheets must have a confidentiality clause to help prevent PHI from being sent to non-intended persons. This clause indicates what an individual should do if this information is received in error. All phone requested information cannot be released without a disclosure. A covered entity should supply a release of information and all information released should pertain to that particular purpose. Security Rule limits unauthorized access, alteration, deletion and transmission of PHI.

Privacy Rule pertains to all protected health information in any form.

Artex Medical, Inc. does not allow visitors into our operational area without being properly signed-in and escorted. Also, privileged information is not visually displayed for visitors. All business associates such as cleaning services, etc. have a signed confidentiality agreement with Artex Medical Inc to protect PHI. PHI cannot be shared with the public. PHI is available to the person which the documentation pertains. PHI can be released to family members if it apparent that they are involved in the person’s health care bills, unless the person objects. For minors, PHI is permitted to parents or guardians as recognized by the state. Covered entities such as physician’s office, home health agencies, hospice, etc. can have access to PHI that pertains to the plan of treatment or billing for that person and only the information pertaining to that purpose.

Example: Mr. Jones has diabetes and we give him testing supplies. ABC home health has just begun diabetic teaching in his home and would like to know how often he orders his supplies. HIPAA allows us to permit the passage of this info for treatment or billing. But we should not permit other info that does not pertain to the treatment of diabetes.

A few exceptions to the disclosure of PHI
  1. Required by law
  2. Public Health authorities for public health reasons
  3. Health research
  4. Abuse, neglect or domestic violence
  5. Law enforcement, court order, subpoena, missing persons
  6. Judicial an administrative proceedings
  7. Organ transplant
  8. Workers Compensation
  9. Emergency or substantial barrier
